Reservation Enquiries: Calls to our 0844 numbers are charged 7 pence per minute, plus your service provider’s access charge over which Choice Hotels Ltd has no control. You should check this access charge directly with your service provider before calling.

The booking conditions set out here apply to bookings made directly with Choice Hotels Ltd Reservations Department or the Hotel Reception. They do not apply to bookings made using any third party websites. Booking terms and conditions for reservations made on third party websites may be found on the website at which the booking is made. Accommodation: Choice Hotels Ltd hotels offer accommodation subject to availability. We may impose a minimum length of stay, and/or set arrival and departure days, and/or set board basis, designated a ‘package’. No reduction to the full cost of a package is made for accommodation and/or included products not required for the full duration of a package. It may be possible to add separate consecutive packages to facilitate a longer stay. It may, at our sole discretion, be possible to engage accommodation for a period of time deviating from a package. In such circumstances, we may charge a supplement in addition to the pro-rata package rate.

Special Requirements: Please advise us of any special dietary needs or other requirements, including mobility issues, you may have at the time of booking. We will check availability for suitable accommodation. Price match: We usually sell accommodation through Online Travel Agents (OTAs). Please call Choice Hotels Reservations Department on 01253 754291 to enquire about a like-for-like price match.

Offers: From time to time, on selected packages, we may offer limited rooms at discounted prices. These offers are subject to availability and may be withdrawn at any time, without notice. Such offers may only be available to telephone bookings. Any such reductions are available to new reservations only, at the time of booking, and are not applied automatically. Reductions are not applicable to existing bookings. Reductions cannot be applied retroactively, or on arrival, while resident, or following departure.

Deposit/ Guarantee and pre-payment: You should arrange travel insurance to cover the cost of cancellation and to safeguard against other risks.

We require a non-refundable non-transferable deposit of £50 per adult, per package for Bed & Breakfast or Half-Board basis/ £75 per adult for All Inclusive basis/ £100 per adult for Christmas package and New Year package. Deposits may be taken over the telephone by valid credit/ debit card. You must supply the card number, expiry date and CVC, as well as the cardholder name and the complete and correctly formatted billing address as registered with your card issuer.

The remaining balance for accommodation and related charges will be taken from this credit/ debit card within four days before arrival. If the card expires before your stay or you wish to use a different card please call Reservations on 01253 754291 at least five days before arrival, quoting your booking reference. This does not apply to Christmas or New Year package bookings, or Group Bookings (10+ adults) – see below.

Please advise us as soon as possible if you have valid Choice Hotels Ltd Gift Vouchers or Choice Rewards Vouchers you wish to use towards payment. We would deduct the value of the vouchers from the final payment amount taken before arrival. Present vouchers at Reception at check-in.

We send confirmation by email two days after we receive a deposit. We do not send a written booking confirmation or a deposit receipt by post; to check the details of your reservation, please call Reservations on 01253 754291.

Cancellation: You should arrange travel insurance to cover the cost of cancellation and to safeguard against other risks. Deposits are non-refundable and non-transferable, at any time for any reason.

For cancellations received within 72 hours before 3pm (hotel local time) on the day of arrival we will retain the deposit as a cancellation charge. We can ‘hold’ the balance for use against a new booking made within three calendar months of the date of cancellation (subject to availability and price difference).

Any sum ‘held’ by us following cancellation of a booking is available for use against a new booking at any Choice Hotel for three calendar months from the date of cancellation (subject to availability and price difference). If no new booking is made within three calendar months then the full sum will be retained as a cancellation charge. The arrival date of any new booking utilising this ‘held’ sum need not be within this three calendar month period but must be within twelve calendar months of the original arrival date.

If there is insufficient time before arrival to process a deposit payment, we require a valid credit/debit card number as a guarantee against cancellation/ non-arrival, and full payment is due on arrival before access to accommodation is granted.

Christmas and New Year Package bookings: A non-refundable, non-transferable deposit of £100 per adult per package is required by credit or debit card no later than 31 March or, for bookings made after 1 April, at the time of booking. Please call our Reservations Office on 01253 754291 no later than 15 November to pay the balance of your stay in full. For bookings made after 15 November, full payment will be taken from the card details provided within two days of booking. In the event of cancellation at any time, for any reason, all payments received for Christmas and New Year package bookings are strictly non-refundable and non-transferable and no correspondence will be entered into. You should immediately arrange appropriate insurance cover to safeguard against potential losses.

Group Bookings: For groups of 25+ adults please contact Choice Hotels Ltd Sales Office for a comprehensive quotation: Email Here. For groups of 10+ adults, we require a non-refundable non-transferable deposit to secure accommodation. Full payment of remaining accommodation charges is due no later than six weeks before the reservation arrival date, along with a Rooming List giving the name, address and telephone number of the lead guest staying in each room booked. Group Booking Terms & Conditions will be sent to the group organiser with confirmation of the booking details.

Conference Bookings: Please contact hotel management directly for a quotation.

Tour Operators: For reservations made by coach/ tour operators, we require full payment up to 12 weeks before the date of arrival. Full tour operator booking terms & conditions will be dispatched with confirmation of the booking details.

Travel/ Booking Agents: The terms and conditions set out here apply to travel agents and booking agents, except those agents with which Choice Hotels Ltd has entered into an arranged and agreed contract. Choice Hotels Ltd does not pay commission.

Function/ Christmas Party Bookings: If available, these should be booked directly with the hotel (see the 'contact' location page of this website). Full Function/ Christmas Party booking terms and conditions will be dispatched with confirmation of the booking.

Adults Only: The Viking Hotel accepts guests aged 18+ only and cannot accommodate anyone aged 17 or under (as on the day of arrival). The Claremont Hotel may on occasion accept guests aged 17 or under during main school holiday periods (with exceptions including Christmas and New Year). At other times all guests must be aged 18+ (as on the day of arrival). Certain periods at the Cliffs Hotel, Patterdale Hotel and Keswick Country House Hotel may also be designated Adults Only, during which time all guests must be aged 18+ (as on the day of arrival). We reserve the right to refuse accommodation and related services to bookings including any guest aged 17 or under during Adults Only periods and no refund would be given, nor other compensation considered.

Single Occupancy: Adult rates are based on two (or more) adults sharing a bedroom, except for Single rooms, if available. Any bedroom other than a Single engaged to accommodate just one adult (aged 15+), plus any other occupant/s aged 14 or under, is subject to a single occupancy charge which may be up to double the individual adult rate, including any and all applicable supplements. In such a case, no reduction is made for any included meals or other product costs.

Child rates: When applicable, configured child rates are available to ages 0-14 inclusive (as on day of departure) when sharing a bedroom with at least two adults. Ages 15+ are charged as adults. If one or more children share a room with one adult we would apply a single occupancy charge to the adult occupant as detailed above.

7 night stays: Except at the Keswick Country House Hotel, bookings for seven nights or longer would comprise two or more separate packages, the individual rates for which would be added together. Solely at our discretion, it may be possible to deviate from published package dates. We may charge a supplement in addition to published package prices.

CHOICE HOTELS WEBSITE ONLINE BOOKING TERMS AND CONDITIONS

The booking conditions set out here apply to bookings made directly on the Choice Hotels website. They do not apply to bookings made using any third-party websites. Booking terms and conditions for reservations made on third party websites may be found on the website at which the booking is made.

There are a limited number of rooms available for the advertised rates. The hotel may have other room availability at a higher tariff or for a specific number of nights. We do not accept Travel Agency bookings made via our website. Travel Agents should call our Reservations Office on 0844 811 5570 to enquire.

During peak periods Choice Hotels Ltd reserves the right to amend reservation accommodation to maximise occupancy.

When available, configured child rates are applicable to ages 14 and under sharing with two adults. Ages 15+ are charged as adults. Please note any children's ages (as on the day of departure) in the Special requests section of the Booking Details form.

The booking portal is unable to reconcile promotion codes and/or apply any associated discounts. If you have received a promotion from us please call Choice Hotels Reservations Department on 01253 754291 to enquire about booking.

Deposit/ Guarantee and Pre-payment:

A valid credit or debit card is required to secure your reservation. You must supply the card number, expiry date and CVC, as well as the card holder name and the complete and correctly formatted billing address as registered with your card issuer.

Unless otherwise stated in the specific booking conditions relevant to your booking, we will take the balance from your card within four days before arrival. If the card expires before your stay or if you wish to use a different card please call Reservations on 01253 754291 at least five days before arrival, quoting the booking reference on your confirmation email.

Please advise us as soon as possible if you have Choice Hotels LTD Gift Vouchers or Choice Rewards Vouchers you wish to use towards payment. We would then deduct the value of the vouchers from the final payment amount taken before arrival. Present any vouchers at Reception when you check in.

Cancellation: We recommend that you arrange travel insurance to cover the cost of cancellation and to safeguard against other risks.

  • Half Board and Bed & Breakfast: You can cancel without charge up to 72 hours before 3pm [local time] on the day of arrival. If the booking is cancelled after this time the full cost of the first night's accommodation will be retained as a cancellation charge. In the case of no-show without notice the full cost of the stay will be charged and retained.
  • Advance Purchase: We will take full payment from the card provided at any time before arrival. In the event of cancellation at any time for any reason, the full cost of the stay is non-refundable and non-transferable.
  • All Inclusive: A non-refundable non-transferable deposit of £75 per adult will be charged to the debit/ credit card provided at the time of booking. Cancellations received within 72 hours of 3pm on the day of arrival (hotel local time) are fully non-refundable and we will retain the total cost of your stay as a cancellation charge.
  • Christmas and New Year: A deposit of £100 per adult will be charged to the debit/ credit card provided at the time of booking. This deposit is strictly non-refundable and non-transferable. The balance is due by 15 November. For cancellations received on or after 15 November, the full cost of the stay is forfeit and no refund or transfer is possible. We advise you to arrange travel insurance to cover losses incurred in the event of cancellation.

No reduction is made for temporary absence, meals not taken, premature departure for any reason, nor for accommodation not required after confirmation of booking.

We recommend that you arrange travel insurance to cover the cost of cancellation and to safeguard against other risks.

GENERAL INFORMATION

Check-in and check-out: Rooms are available from 4pm on the day of arrival and must be vacated by 10.30am (11am at the Keswick Country House Hotel) on the day of departure. At our sole discretion, it may be possible to store luggage for early arrivals/ late departures but Choice Hotels Ltd accepts no responsibility for theft, loss or damage to stored luggage.

Entertainment: Where entertainment is offered, the management reserves the right to alter the entertainment program without notice.

Requests: We do our utmost to comply, but note that requests including, but not limited to, room number, position and/or specific attribute, and early check-in are emphatically not guaranteed and do not constitute any part of your contract with us. We prioritise allocation of suitable accommodation to guests with essential requirements, and such requirements always take precedence over preference requests. Special requests, when possible, would only be confirmed to you on arrival at the hotel.

Accessibility: Accessibility surveys at our hotels have identified hazards at the Viking Hotel and Keswick Country House Hotel which cannot reasonably or practically be overcome. These hotels are therefore unsuitable for those with limited mobility. The Cliffs Hotel, Claremont Hotel and Patterdale Hotel may be more suitable, each having some level, ramped or lift access and some bedrooms which provide increased ease of use for those with limited mobility. Further information regarding accessibility can be obtained from Choice Hotels Ltd Head Office on 01253 754225. Unless advised, we will assume that you and all members of your party are able to recognise an alarm and evacuate the building without assistance.

All Inclusive: Details of All Inclusive breaks can be found on the All Inclusive Offers web pages and we reserve the right to alter this without notice. A maximum of two alcoholic drinks will be served per person, per visit to the bar. Under the Licensing Act 2003 we will refuse to serve drinks to any person who appears to be under the influence of alcohol. As responsible suppliers we will also refuse to serve drinks to any person we consider to have consumed an excessive amount of alcohol. Our All Inclusive packages are for residents only – non-residents are not permitted on the premises.

Safe Environment: We want to maintain a safe and secure environment for you and your family and may ask for your identification on arrival. We do not knowingly allow anyone to use or visit our hotels who is a convicted child sex offender, subject to the notification requirements of the Sexual Offences Act 2003, or subject to a Sexual Risk Order, Risk of Sexual Harm Order or Child Abduction Notice.

It is your responsibility to ensure that your personal possessions and valuables are kept safe and secure at all times whilst visiting any of our hotels. We accept no responsibility for loss of, or damage to, your personal possessions and valuables other than our liability as proscribed by the Hotel Proprietors Act. You should ensure that any valuable items are covered by your own insurance. Please note that we do not provide safes in bedrooms. We may be able to store valuables in our Hotel Reception safes – please speak to Reception staff.

Content and Information: Whilst we take care to ensure that information provided online, in print, and verbally is correct, we do not warrant its completeness or accuracy; nor do we commit to ensuring that information is up-to-date.

If we find out we have undercharged you in error, we will get in touch to give you the choice of cancelling your break for a refund or paying the full price, with no further liability on our part. If we’ve overcharged you by mistake, we will refund the difference in price.

Please note that we use generic photographic images to represent the general style of our hotels and facilities.

Complaints or Comments: The company is proud of the standards of accommodation and service offered to all guests. In the unlikely event that you should have cause for criticism or suggestion during your stay, please bring the matter to the attention of a Choice Manager so that efforts may be made to meet your requirements or resolve problems. We consider it unreasonable to make any criticism in writing upon your return home should we not first have been given the opportunity to attend to any matters arising during your stay.

GUEST RULES:

You must ensure you (and your own guests if applicable) behave responsibly, at all times, whilst at one of our hotels. Our staff reserve the right to require you to leave the premises for any unacceptable behaviour, including but not limited to verbal or physical abuse towards our staff or other guests.

We will charge any individuals causing deliberate, accidental or reckless damage to company property or structures. If such damage is discovered while on company premises we will draw it to the attention of the responsible party, or if discovered after they have departed we reserve the right to charge the credit/debit card provided at the time of booking or on arrival, in order to recoup any incurred costs and associated loss of revenue.

You shall ensure that you (and your own guests if applicable) have regard to any regulations imposed by any competent authority, and that nothing shall be done which will constitute a breach of the law.

Smoking and vaping are not permitted in any Choice Hotels Ltd building or entrance area. This includes the use of electronic cigarettes. Failure to comply constitutes a criminal offence under the Health Act 2006. We will charge anyone who contravene this directive in order to recoup cleaning and other costs associated with restoring any affected areas to a smoke free condition, and any associated loss of revenue. Each hotel has a designated outside smoking area to accommodate the needs of guests who smoke.

We operate a responsible drinking policy throughout our hotels and our staff reserve the right to refuse service at their sole discretion if they consider it appropriate to do so.

We have a zero-tolerance approach to the use of illegal drugs on company premises.

Only food and drink served on the premises may be consumed in the public areas.

The terms and conditions set out here comprise part of the agreement between you and Choice Hotels Ltd. The contract is deemed to have been made upon our receipt of the deposit. No employee or representative of the Company has the authority to verbally vary these terms and conditions. We will not be in a position to vary these conditions unless requested to do so in writing, with such variation confirmed by us in writing.

Choice Hotels Ltd – Choice Rewards Terms & Conditions

These are the terms and conditions for the Choice Hotels Ltd Rewards loyalty programme run by Choice Hotels Ltd (“Terms”). By joining the Choice Rewards programme (“Membership”) and using an associated QR code, you agree to these Terms.

Please read these Terms carefully, paying particular attention to clause 8 (which sets out the extent of our potential liability in relation to the Choice Rewards programme) and clause 6 (regarding our right to vary these Terms from time to time).

1. Introduction

1.1. We are Choice Hotels Ltd (“we”, “us” and “our”). For details of our company please visit our website choicehotels.co.uk

1.2. Properties owned and operated by Choice Hotels Ltd are the Cliffs Hotel, Claremont Hotel and Viking Hotel in Blackpool, and the Patterdale Hotel and Keswick Country House Hotel in the Lake District (Cumbria).

1.3. Choice Rewards is a free loyalty programme which provides individual guests with benefits and, from time to time at our discretion, potential promotional discounts when staying at one of our hotels. Choice Rewards system technology is provided, operated and maintained by BlueRunner Solutions Limited on behalf of Choice Hotels Ltd.

2. Choice Rewards Membership

2.1 Choice Rewards membership is provided free of charge. To receive Choice Rewards membership you must register online by downloading the Choice Rewards app to a compatible smart device or at choicerewards.co.uk and completing the application process. The Choice Rewards App generates a scannable QR Code associated with your Choice Rewards account. If you do not have a compatible smart device you can request a physical Choice Rewards card printed with a membership QR Code online at choicerewards.co.uk. We are unable to issue a physical card to members who have the app as QR codes cannot be duplicated on different media. Shortly after joining you should receive a welcome email with information about your membership. Physical cards are issued by and remain the property of Choice Hotels Ltd. We do not authorise anyone else to sell or distribute cards. Choice Rewards cards are not credit or debit cards. If you lose the card, or lose access to the app (for instance, if your device is lost or stolen) you must inform us immediately.

2.2 Choice Rewards members are required to provide some personal details in order to register. This personal data will be processed in accordance with our data protection policies (see clause 7). You may amend these details at any time by accessing your account online.

2.3 Choice Rewards is only available to individual guests aged 18 or older. It is not available to companies, legal entities or other organisations or anyone who operates as a representative or employee of any such organisation. Membership, cards and Rewards Points cannot be transferred or assigned to anyone else. Each app generated QR code or physical Choice Rewards Card is personal to the membership holder or relevant card user to whom it is issued. Members of the same household can register under a single Rewards account.

3. Choice Rewards membership Rewards Points and Benefits

3.1 You can use your membership to earn Choice Rewards Points on certain payment transactions made directly with Choice Hotels Ltd. From time to time you may also receive notification of Choice Rewards special promotions, and bonus Rewards Points events, either through the Choice Rewards app, or by email.

3.2 Please note that you must be registered online to enable you to earn and redeem Rewards Points.

3.3 Earning Rewards Points

3.3.1 Standard Booking: you will earn up to 3 Rewards Points for every £1 spent at Choice Hotels Ltd venues on accommodation for a maximum of one bedroom, and on drinks and food at our bars and coffee shops.

3.3.2 Group Booking (10+ adults under a single booking reference):

The Group Organiser earns up to 3 Rewards Points per £1 spent on their individual bedroom, plus 150 Rewards Points for each additional resident guest (paying adult rate) booked on the Group Reservation under one single primary booking reference. 150 Rewards Points are not credited for any guests staying in the Organiser’s individual bedroom, any children, any guests staying under a separate booking reference, or any non-residents.

Individual guests who are members of Choice Rewards may earn up to 3 Rewards Points per £1 spent on the cost of their accommodation, and on drinks at our bars and coffee shops.

3.4 To earn Rewards Points you must:

· 3.4.1 Be a member of the Choice Rewards loyalty programme

· 3.4.2 Book directly with us (whether over the phone, on our website booking portal accessible at www.choicehotels.co.uk or at one of our venues)

· 3.4.3 When collecting Rewards Points for accommodation, the name of the lead resident guest must match the name on the Choice Rewards account

3.5 Please note that you cannot earn Rewards Points through third party bookings. These include those made via booking agents, holiday/ tour operators, physical travel agents, online travel agents including Booking.com, Expedia, Hotels.com or any associated or subsidiary organisations, or utilising vouchers issued by Deal Publishers such as Travel Zoo. For more information please ask a member of our team.

3.6 Rewards Points will not be awarded against the purchase of Choice Hotels Ltd Gift Vouchers.

3.7 Rewards Points are not awarded for organisers or attendees of function bookings (if available), including room hire, meetings, meal functions, celebration events, festive parties, or non-resident entertainment at Talk of the Coast. Nor are Rewards Points awarded to business guests or conference attendees.

3.8 To earn Rewards Points for an accommodation charge, or for applicable products from our bars and coffee shops charged to your room account during your stay, your QR Code must be scanned at check-in. Please note that the room credit facility is available at our sole discretion, and only on completion of a successful payment card pre-authorisation transaction.

3.9 Rewards Points cannot be earned or redeemed against menu items from our coffee shops.

3.10 Rewards Points cannot be earned or redeemed against retail products from Reception (for example, postage stamps or bingo dabbers), or products or services we sell as agents (for example, travel passes or attraction venue tickets).

3.11 To earn Rewards Points for applicable drinks at the point of sale in our bars, you must scan your QR Code before each individual transaction.

3.12 Rewards Points cannot be added after a transaction is complete.

3.13 Spending Rewards Points – Each Rewards Point has no cash value but, where redeemable, is equivalent to one penny, and can be used against certain purchases made directly with Choice Hotels Ltd. Rewards Points can be used in all Choice Hotels Ltd venues.

3.14 Rewards Points cannot be used in conjunction with any other promotion or discount unless otherwise specified.

3.15 When Rewards Points are redeemed as payment, no Rewards Points will be awarded for the portion of the charge equivalent in value to the Rewards Points being redeemed.

3.16 Certain products may be excluded from the scheme at any time, or the Rewards Points awarded reduced at any time, at our discretion. Any Rewards Points earned on purchases which are subsequently cancelled or refunded will be deducted from your Rewards Points balance.

3.17 For current Rewards Points earning levels please refer to the Choice Rewards app or visit our Rewards Website

3.18 Rewards Points have no cash value and cannot be redeemed, refunded, exchanged or transferred.

4. Online Accounts

4.1 When you register as a member you will be provided with an account which you can access via the Choice Rewards app or online at choicerewards.co.uk. It is your responsibility to keep your account details confidential and up-to-date.

4.2 We do not guarantee that your online account will always be available (for example, due to maintenance or network interruptions) and we do not accept any liability which arises as a result of or in connection with you being unable to access your account.

4.3 We use reasonable endeavours to ensure our website and the Choice Rewards app are safe and secure, but we will not accept liability for any loss or damage which occurs as a result of you using our website, the app, or your online account (including damage resulting from malicious software) and it is your responsibility to ensure your device is kept secure and passwords are updated periodically.

5. Variation and Assignment

5.1 The Choice Rewards programme is provided at our discretion and we reserve the right to amend or waive any provision of these Terms and Conditions from time to time and at any time, or to terminate the Choice Rewards program with reasonable notice.

5.2 We will normally only make changes to the Choice Rewards programme to provide you with improved benefits, but there may be situations where we are required to make changes due to circumstances outside our control.

5.3 If at our sole discretion we determine it necessary to make changes which reduce benefits we will make reasonable efforts to inform you (see sub-clause 5.4)

5.4 Any significant changes to the Choice Rewards programme or these Terms will be notified to you by email or posted on our website. Your continued use of the card shall constitute your acceptance of such terms and conditions.

5.5 The Choice Rewards programme is provided free of charge and we will not be liable for any costs, damages or losses which arise out of or in connection with the programme (or any part of it) being varied or cancelled.

6. Data Protection

6.1 We collect personal data you provide to us (e.g. when registering as a member or communicating with us). We use your personal data to perform our obligations and exercise our rights under these Terms and, where applicable, to provide you with other services.

6.2 If you are opted into marketing and unless you choose to opt out, we may also use your personal information to keep you up to date on the Choice Rewards programme and to inform you about other relevant products/services offered by us which may be of interest to you.

6.3 Your personal data may be stored by us or our partners, and this may result in it being transferred outside of the European Economic Area.

6.4 If you wish to opt out of marketing communications or you would like to access or correct any of your personal data we hold then you can do so by emailing rewards@choicehotels.co.uk or (where applicable) using the unsubscribe link on marketing emails or updating your preferences using your online account.

7. Liability of Choice Hotels Ltd

This clause sets out the extent of our potential liability to you and therefore please read it carefully.

7.1 Neither Choice Hotels Ltd, nor any member of its corporate group shall be held liable for any default resulting directly or indirectly from any cause beyond our control, including but not limited to, failure of network services and failure of data processing systems. To the extent permitted by law, all conditions or warranties implied by law, statue or otherwise are expressly excluded.

7.2 Choice Hotels Ltd will not be liable to you for:

· 7.2.1 any loss of income, business, goodwill or profits arising out of this agreement;

· 7.2.2 any unauthorised access to or alteration, theft or destruction of your card;

· 7.2.3 the consequences of any delay or mistake relating to the use of your account caused by any circumstances beyond our control;

· 7.2.4 any loss or damage which was not caused by our breach of this agreement or breach of our legal duty of care;

· 7.2.5 any loss or damage which was not a reasonably foreseeable result of either our breach of this agreement or breach of our legal duty of care. Loss or damage is "reasonably foreseeable" if, at the time we entered into this agreement, such loss was contemplated by you and by us; or

· 7.2.6 any loss or damage suffered by you as a result of you failing to take reasonable precautions against such loss or damage.

7.3 This agreement does not affect your statutory rights and must be read subject to those rights. If you require more information on your statutory rights you should contact your local authority Trading Standards Department or Citizens Advice Bureau.

7.4 Choice Hotels Ltd does not represent or warrant that your QR code/ card will always be accessible or accepted at participating hotels.

7.5 The Financial Ombudsman Compensation Service is not applicable to your membership. Choice Hotels Ltd does not offer any other compensation schemes to cover losses claimed in connection with your membership.

8. Choice Rewards Expiry

8.1 Your membership does not have an expiry date. However, if you do not use your account membership for a period of one year or more, it will cease to be valid and any remaining credit value stored on it will expire.

8.2 Rewards Points earned have a maximum use life of two years. Rewards Points older than two years will expire and cannot not be redeemed.

8.3 Checking the balance on your account and the registering of bonus Rewards Points will not constitute use of the membership account for these purposes. Expired value cannot be transferred to a new card or redeemed. You will not be able to use your membership account once it has ceased to be valid.

9. Redemption and Termination

9.1 You are entitled to redeem at any time any unexpired and unused stored value on your membership provided:

9.2.1 We have no reason to suspect that you are engaged in fraudulent or other criminal activities and;

9.2.2 We are not prohibited from redeeming that stored value by any applicable law, regulation, court order or instruction or guidance of a competent regulatory authority.

9.3 We may terminate your membership immediately if:

9.3.1 you breach any of these terms

9.3.2 we reasonably believe that your membership is being misused or used by another person or

9.3.3 we reasonably believe your continued membership may result in damage to us, our brand or our reputation. 9.4 you may terminate your membership and account at any time by contacting us at rewards@choicehotels.co.uk. Termination may take up to 12 weeks to process.

9.5 Under no circumstances shall we be liable to pay you any compensation or damages as a result of your membership being terminated.

10. Loss, Theft and Damage

10.1 Choice Hotels Ltd is not liable for lost, stolen, or damaged Choice Rewards cards or accounts.

10.2 Replacement cards will be posted to your registered home address only.

10.3 If you subsequently find or retrieve a card or account which you have reported lost or stolen, you must notify us immediately by calling 01253 754264.

11. General

11.1 All intellectual property rights relating to the Choice Rewards programme (including our logo) are reserved to us, and nothing in these Terms shall grant or assign any right, title or interest in such rights.

11.2 A delay or failure to enforce any provision in these terms shall not constitute a waiver of that right or remedy, or of any preceding, subsequent or continuing breach.

12 Entire Agreement: Construction

12.1 This agreement (as amended from time to time) constitutes the entire agreement between you and Choice Hotels Ltd and supersedes all prior proposals and all other agreements in respect of the subject matter of this agreement. If any provision of this agreement is illegal or unenforceable, that provision will be deleted from this agreement, and the remaining terms will not be affected.

12.2 The agreement relating to your use and Membership is between you and us and is not intended to confer a benefit on any third party. The Contracts (Rights of Third Parties) Act 1999 is excluded.

13 Governing Law

13.1 These terms are governed by UK law and any disputes arising out of or in relation to them (including non-contractual disputes) must be brought in UK courts

Hotel Proprietors Act 1956

SCHEDULE NOTICE

Loss of or Damage to Guests’ Property

Under the Hotel Proprietors Act 1956, an hotel proprietor may in certain circumstances be liable to make good any loss of or damage to a guest’s property even though it was not due to any fault of the proprietor or staff of the hotel.

This liability however —

  • a. extends only to the property of guests who have engaged sleeping accommodation at the hotel;
  • b. is limited to £50 for any one article and a total of £100 in the case of any one guest, except in the case of property which has been deposited, or offered for deposit, for safe custody;
  • c. does not cover motor-cars or other vehicles of any kind or any property left in them, or horses or other live animals.

This notice does not constitute an admission either that the Act applies to this hotel or that liability thereunder attaches to the proprietor of this hotel in any particular case.
